Arbitrator Accepts Majority Of Kenrich’s Opinions; Awards Kvaerner $74 Million
Kenrich was retained by Dorsey & Whitney LLP which represented Kvaerner North American Construction, Inc. (a subsidiary of Kvaerner) in arbitration proceedings against Foster Wheeler North America Corporation related to the Longview Power project delivered in 2011. Dorsey prevailed and Kvaerner North American Construction Inc. will be awarded from the arbitration proceedings USD $74 million in cash from Foster Wheeler North America Corporation. The majority of the opinions offered by Kenrich were adopted by the arbitration panel.
Kenrich CEO Rich Sieracki led a team of Kenrich consultants primarily from the Austin, Chicago, and Minneapolis offices. The Kenrich team included the following Vice Presidents: Neil Miltonberger, Scott Hollingsworth and Chris Beirise.
The dispute related to claims arising out of the design and construction of the Longview Power Plant. Kenrich authored multiple reports and testified at arbitration proceedings addressing issues including schedule delays, liquidated damages, Force Majeure events, modularization/pre-fabrication issues, subcontractor change orders and other damages components.
